An Eastern Europe case study: the PLK Bank case

This case study is based upon draws heavily from an article entitled “Case Study: The Out-of-Court Restructuring of a Latvian Bank,” which first appeared in Spring 2000 Edition of Law in Transition, the twice-yearly publication of the Office of the General Counsel at the European Bank for Reconstruction and Development (“EBRD”). That article was prepared by Adrian Cohen, Partner, and John MacLennan, Assistant, both from Clifford Chance (London), with the help of and assistance from Lauris Liepa, now a partner with Liepa, Skopina / BORENIUS in Riga. Mr. Cohen, Mr. MacLennan and Mr. Liepa acted representing Fuji Bank (London), Landesbank Schleswig – Holstein and EBRD in the restructurig and subsequent sale of PLK and each have kindly consented to their original work being adapted for publication in this work. Mortgage on lease rights?

The Supreme Court of Latvia has adopted two decisions (Case No. SKC – 667 and SKC – 575), respectively on September 8 and November 3, 2004, thereby recognizing that no lease rights registered with the land book can serve as mortgage subjects. However, the justification of the decisions of the Supreme Court was rather contradictory. Read more »

A Review on „the Law on Closure of Privatization of State-owned and Municipal Property and Termination of Usage of Privatization Certificates.”

On June 16, 2005 the Parliament of the Republic of Latvia (the Saeima) passed a law on Closure of Privatization of State-owned and Municipal Property and Termination of Usage of Privatization Certificates.

The scope of this law is to ensure closure of privatization of state-owned and municipal property and termination of distribution and usage of privatization certificates for privatization, alienation or buying-out of state-owned or municipal property. Read more »
